What Is a Release of Claims?

A Release of Claims is a written agreement in which a person gives up specified legal claims against another party, often as part of a settlement. The document identifies the released parties and the claims covered. Signing it may limit or end the signer’s ability to seek additional compensation for those claims.

Key Takeaways About Release of Claims

  • A release defines which claims and parties are covered.
  • Signing may prevent later recovery for covered harm.
  • A release is not the same as a settlement offer.

How Release of Claims Works

A man in a suit points at a "RELEASE OF CLAIMS" form while speaking to a woman across a table

A Release of Claims works by stating the rights a person gives up and the parties protected by the agreement. The language may address known injuries, related losses, and claims that arise from the same incident. The scope depends on the wording, so each sentence deserves careful review.

Related glossary terms: Settlement Demand, Medical Lien, Subrogation.

A release commonly appears after the parties agree on settlement terms. The person receiving payment signs the document, and the other party receives protection from the covered claims. A settlement agreement may contain the release, while a medical lien can affect how settlement funds are handled without becoming part of the release itself.

From the Atlanta Auto Law team

When we review a Release of Claims in a rideshare case, we check the covered incident, released parties, injury language, and payment terms. We also compare the release with available insurance coverage and outstanding medical liens. Our team looks for language that could affect claims involving later-discovered injuries.

Release of Claims in Practice: A Real-World Example

A rideshare passenger suffers a back injury after a collision and receives a proposed settlement. Before signing the Release of Claims, the passenger reviews whether the document covers only the collision claim or also claims against other potentially responsible parties.
